This Messaging Program Privacy Policy explains how Acuity Eye Group collects and uses information about you in relation to its text message program (the “Messaging Service”). We use Salesforce Marketing Cloud to provide the Messaging Service to you. For the purposes of the Messaging Service, Salesforce Marketing Cloud acts as our service provider and data processor of your information.

Program Description

Acuity Eye Group and its service providers may use an automatic telephone dialing system (“auto dialer”) to deliver text messages to you. Program includes: appointment reminders, welcome texts, survey texts regarding appointment experience, pre-op information, and post-op care information. Consent to receive text messages is not required as a condition of receiving services. Message Frequency The number of Acuity Eye Group text messages that you receive will vary.

Cost

Message and data rates may apply to each text message sent or received in connection with Acuity Eye Group text messages, as provided in your mobile telephone service rate plan (please contact your mobile telephone carrier for pricing plans), in addition to any applicable roaming charges. Acuity Eye Group does not impose a separate fee for sending Company text messages.

Supported Carriers

Supported carriers may change from time to time, but currently include AT&T, T-Mobile, Verizon Wireless, Sprint, Nextel, Boost, Alltel, US Cellular, and Cellular One, among others. T-Mobile is not liable for delayed or undelivered messages.

Collection of Information

We collect various information on our behalf from and about you, including information you directly provide when you use the Messaging Service. For example, we collect the phone number and email address you provided when scheduling your appointment or submitting an inquiry. When you send messages via the Messaging Service, we will also collect your messaging history and any information included in those messages.

Use of Information

We use your information to deliver, analyze, maintain and support the Messaging Service. We may also use your information to enhance the Messaging Service features and customize and personalize your experiences on the Messaging Service.

Sharing of Information

We may share, transfer, or disclose your information, if you consent to us doing so, as well as in the following circumstances: Service Providers. We may share your information with third parties to help us provide the Messaging Service to you.

Legal Requirement and Protection of Attentive and Others.

We may disclose your information as we believe such disclosure is necessary or appropriate to:
(i) comply with applicable law and legal processes; (ii) respond to requests from public and government authorities, including public and government authorities outside your country of residence; (iii) enforce a contract with us; (iv) protect our rights, privacy, safety, or property, and/or that of our affiliates, you or others; and (v) allow us to pursue available remedies or limit the damages that we may sustain.

From time to time, we may share aggregate or de-identified information about use of the Messaging Service.

Protection of Information

We take a variety of physical, technical, administrative, and organizational security measures based on the sensitivity of the information we collect to protect your information against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access. Unfortunately, no online activity can be guaranteed to be 100% secure. While we strive to protect your information against unauthorized use or disclosure, we cannot ensure or warrant the security of any information you provide. We do not accept liability for unintentional disclosure. Retention of Information We retain your information for as long as you participate in the Messaging Service or as needed to comply with applicable legal obligations. We will also retain and use your information as necessary to resolve disputes, protect us and our customers, and enforce our agreements.

Choices and Controls

Consent to receive automated text messages is not required for the purpose of messaging in regards to your eye care services. You can opt-out of receiving further text messages via the Messaging Service by responding to any of our text messages with any of the following replies: STOP. Mobile Telephone Number

You represent that you are the account holder for the mobile Telephone number(s) that you provide. You are responsible for notifying Acuity Eye Group immediately if you change your mobile telephone number. You may notify Acuity Eye Group of a number change by submitting a “contact us” form on the website. You agree to indemnify Acuity Eye Group in full for all claims, expenses, and damages related to or caused in whole or in part by your failure to notify Acuity Eye Group if you change your telephone number, including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act.

Termination of Text Messaging

Acuity Eye Group may suspend or terminate your receipt of text messages if Acuity Eye Group believes you are in breach of these SMS Terms and Conditions. Your receipt of text messages is also subject to termination in the event that your mobile telephone service terminates or lapses. Acuity Eye Group reserves the right to modify or discontinue, temporarily or permanently, all or any part of the text messages, with or without notice. Access or Delivery to Mobile Network is Not Guaranteed Delivery of information and content to a mobile device may fail due to a variety of circumstances or conditions. You understand and acknowledge that network services, including but not limited to mobile network services, are outside of Acuity Eye Group’s control, and Acuity Eye Group is not responsible or liable for issues arising from them.

Eligibility

To receive Acuity Eye Group text messages, you must be a resident of the United States and 18 years of age or older. Acuity Eye Group reserves the right to require you to prove that you are at least 18 years of age.

Changes to Terms and Conditions

Acuity Eye Group may revise, modify, or amend these SMS Terms and Conditions at any time. Any such revision, modification, or amendment shall take effect when it is posted to Acuity Eye Group’s website. You agree to review these SMS Terms and Conditions periodically to ensure that you are aware of any changes. Your continued consent to receive Acuity Eye Group text messages will indicate your acceptance of those changes
